What Is A Land Trust And Why You Must Have It?
A land Trust is a variation of a living trust that actually converts an interest or ownership of a real estate property into a beneficiary or beneficiaries through a trustee.
In a land trust, there are three major players, grantor(s), trustee, and beneficiary(s). The grantor converts the ownership or interest of a real estate property under the land trust through a trustee. The trustee acts on behalf of the beneficiaries of the trust. The beneficiaries receive the interest or ownership of the subject property. But, the beneficiaries are the “invisible†owners of the property.
The grantor can also be one of the beneficiaries. As the grantor(s), you can name anyone to be your beneficiaries, which include yourself.
Why you must create land trusts for all of your properties?
There are many benefits to do so. Following are the major benefits to place your property(s) into a land trust(s):
1. Privacy
As the beneficiaries, your name and any other names on the list of beneficiaries are not on the public record. It is completely anonymous. You are invisible to whoever individuals wanting to know what you own, how much you paid for, and how much you own.
2. Protection from creditors and predators
If there is an unforeseen accident, judgment or any lawsuit against you with an attachment to the properties you own, the properties under land trust are isolated from the lawsuit because attorneys will not know who owns the property(s).
3. No probate
A human being dies. But, a trust does not die. Therefore, you can avoid probate and all the ugly, costly, and painful things associated with the probate process.
